Terms and Conditions

Welcome to Lumindas Beach Resort. By making a reservation, accessing our website, or staying at our resort, you agree to the following Terms and Conditions.

1. Reservations and Payments

All reservations are subject to availability and are only confirmed upon receipt of the required deposit or full payment.​

• Payment of total amount is due upon arrival unless otherwise agreed

• Accepted payment methods: cash (PHP), bank transfer, and selected online payment platforms

• Any bank or transfer fees are the responsibility of the guest

• Prices may change without prior notice unless a booking has been confirmed

• All rates are inclusive of applicable taxes and service charges

 

2. Check-In and Check-Out

• Check-in from 9:00 AM to 3:00 PM

• Check-out from 6:00 AM to 11:00 AM

 

Early check-in and late check-out are subject to availability and may incur additional charges.

If a guest expects to arrive late, the resort must be informed in advance. Bookings may be released after 7:00 PM on the arrival date in case of no-show without prior notice.

 

3. Cancellation and No-Show Policy

• Cancellations made at least 3 days before arrival are eligible for a full refund

• Cancellations made after this period may be charged up to 100% of the booking amount

• No-shows will be charged 100% of the total reservation cost

• Refund processing times depend on the payment provider and any transaction fees may be deducted

 

4. Occupancy 

• Maximum room occupancy must be respected at all times

 

5. Guest Responsibilities

Guests agree to:

• Respect resort property, staff, and other guests

• Comply with all applicable laws of the Republic of the Philippines

• Be liable for any loss or damage caused during their stay

• Refrain from illegal, dangerous, or disruptive behavior

The resort reserves the right to refuse service or terminate a stay without refund in cases of misconduct.

 

6. Resort Rules

• Quiet hours: 11:00 PM – 7:00 AM

• Smoking is only permitted in designated areas

• The use of resort facilities (including beach and water areas) is at the guest’s own risk

 

7. Natural Environment and Utilities

Guests acknowledge that the resort operates in a tropical island environment.

• The resort cannot guarantee uninterrupted electricity, water supply, or internet access

• Temporary outages may occur due to weather, maintenance, or external providers

• The resort is not liable for inconveniences caused by such interruptions

Guests use the beach and sea at their own risk. Natural conditions such as currents, marine life, and weather may vary.

 

8. Liability Disclaimer

• The resort is not responsible for loss, theft, or damage to personal belongings

• Guests are encouraged to use available safekeeping options where provided

• The resort shall not be held liable for injuries, accidents, or damages unless caused by proven negligence

• To the extent permitted by law, liability is limited to the total amount of the guest’s booking

 

9. External Services and Tours

The resort may assist in arranging transportation, tours, or activities provided by third parties.

• These services are operated by independent providers

• The resort assumes no liability for any loss, injury, delay, or damages related to such services

 

10. Food and Beverage

• Restaurant operating hours may vary

• Menu items are subject to availability

• Guests must inform staff of any allergies; however, the resort cannot guarantee allergen-free preparation

 

11. Force Majeure

The resort shall not be held liable for failure or delay in performance due to circumstances beyond its control, including but not limited to natural disasters, extreme weather, government actions, pandemics, or transportation disruptions.

 

12. Website Use

All content on the resort’s website is provided for general information purposes only.

Unauthorized use of the website may result in legal action.

 

13. Privacy

Personal data is handled in accordance with applicable laws, including the Philippine Data Privacy Act of 2012. Please refer to our Privacy Policy for further details.

 

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of the Philippines.

Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Puerto Princesa/Palawan.

 

15. Amendments

The resort reserves the right to amend these Terms and Conditions at any time. Updated versions will be effective upon publication on our website.​​
